Digital artifacts often fail to perform as expected. It has recently been argued that this should not be analyzed as software malfunctioning. Rather, every case that is not the result of hardware failures would be due to design errors. This claim, which hinges on the notion of ‘implementation’, highlights a potential fundamental difference between software and other technical artifacts. It also implies that software engineers have more extensive responsibilities than creators of other artifacts. After reconstructing the argument, we show that (...) it rests on two presuppositions regarding the nature of software and the activities of its creators, which we call ‘complete control’ and ‘self-containedness’. Software is taken to be a self-contained unit through which the software engineer exerts complete control over a machine’s behavior. These two presuppositions as well as the usage of implementation and strong claims regarding responsibility can be found throughout the literature on software engineering. Still, we argue that the presuppositions are untenable in light of current practices. For one thing, software engineers cannot exert complete control because software has become too complex for any technique to reliably locate every fault in it. For another, the creation and running of software are nowadays heavily mediated processes involving many agential activities. As a result, the performance of digital artifacts may vary, often in undesirable ways, without either hardware failures or design errors. This undermines the conclusion that software cannot malfunction, while also revealing the complications in developing a metaphysical account of software that fits contemporary practices. (shrink)

In this paper I propose a reading of Plotinus Enneads VI.1-3 [41-43] On the genera of being which regards this treatise as a coherent whole in which Aristotle's Categories is explored in a way that turns it into a decisive contribution to Plotinus' Platonic ontology. In addition, I claim that Porphyry's Isagoge and commentaries on the Categories start by adopting Plotinus' point of view, including his notion of genus, and proceed by explaining its consequences for a more detailed reading of (...) the Categories. After Plotinus' integration of the Categories into the Platonic frame of thought Porphyry saw the possibilities of exploiting the Peripatetic tradition both as a means to support the Platonic interpretation of the Categories and as a source for solutions to traditional questions. His allegiance to a division of being into ten, and his emphasis on semantics rather than ontology can be explained from this orientation. In the light of our investigation the alleged disagreement between Plotinus and Porphyry on the Categories changes its appearance completely. There are differences, but these can be best explained as confirmation and extension of Plotinus' perspective on the Categories and its role in Platonism. (shrink)

Jaap Mansfeld and Frans de Haas bring together in this volume a distinguished international team of ancient philosophers, presenting a systematic, chapter-by-chapter study of one of the key texts in Aristotle's science and metaphysics: the first book of On Generation and Corruption. In GC I Aristotle provides a general outline of physical processes such as generation and corruption, alteration, and growth, and inquires into their differences. He also discusses physical notions such as contact, action and passion, and mixture. These (...) notions are fundamental to Aristotle's physics and cosmology, and more specifically to his theory of the four elements and their transformations. Moreover, references to GC elsewhere in the Aristotelian corpus show that in GC I Aristotle is doing heavy conceptual groundwork for more refined applications of these notions in, for example, the psychology of perception and thought, and the study of animal generation and corruption. Ultimately, biology is the goal of the series of enquiries in which GC I demands a position of its own immediately after the Physics. The contributors deal with questions of structure and text constitution and provide thought-provoking discussions of each chapter of GC I. New approaches to the issues of how to understand first matter, and how to evaluate Aristotle's notion of mixture are given ample space. Throughout, Aristotle's views of the theories of the Presocratics and Plato are shown to be crucial in understanding his argument. (shrink)

In this paper I explore the ways in which Alexander of Aphrodisias employs and develops so-called ‘common notions’ as reliable starting points of deductive arguments. He combines contemporary developments in the Stoic and Epicurean use of common notions with Aristotelian dialectic, and axioms. This more comprehensive concept of common notions can be extracted from Alexander’s commentary on Metaphysics A 1–2. Alexander puts Aristotle’s claim that ‘all human beings by nature desire to know’ in a larger deductive framework, and adds weight (...) to Aristotle’s use of the common understanding of the notion of ‘wisdom’. Finally I will indicate how these upgraded common notions are meant to play an important role in the general framework of metaphysics as a science. (shrink)

The notion of a migration system is often invoked but it is rarely clearly defined or conceptualized. De Haas recently provided a powerful critique of the current literature highlighting some important flaws that recur through it. In particular, migration systems tend to be identified as fully formed entities, and there is no theorization as to how they come into being and how they break down. The internal dynamics which drive such changes are not examined. Such critiques of migration systems (...) relate to wider critiques of the concept of systems in the broader social science literature, where they are often presented as black boxes in which human agency is largely excluded. The challenge is how to theorize system dynamics in which the actions of people at one time contribute to the emergence of systemic linkages at a later time. This article focuses on the genesis of migration systems and the notion of pioneer migration. It draws attention both to the role of particular individuals, the pioneers, and also the more general activity of pioneering which is undertaken by many migrants. By disentangling different aspects of agency, it is possible to develop hypotheses about how the emergence of migrations systems is related to the nature of the agency exercised by different pioneers or pioneering activities in different contexts. This volume sheds new light on Alexander of Aphrodisias' On Mixture and Growth as an intelligent and carefully crafted rebuttal of Stoic blending, which Alexander regarded as the closest rival of his own brand of hylomorphism. The authors explore Alexander's dialectical method and determine the precise character of the Stoic theory he attacks. The problematic notions of mutual co-extension and infinite division appear in their proper context, while the successive stages of the process of blending are carefully distinguished from the (...) resulting state of the blend. In this perspective the discussion of growth that closes Alexander's work finds its natural place. (shrink)

Um 1800 verstärkt sich das Problembewusstsein für eine der wissenschaftlichen Reflexion adäquate Darstellung, da sich die Überzeugung durchsetzt, die Sprache sei nicht nur ein Werkzeug, sondern vielmehr ein »bildendes Organ des Gedankens«. Das enge Verhältnis von Aussage und Ausdruck rückt die Wissenschaft in der deutschen Tradition geradezu zwangsläufig in die Nähe zur Literatur. Dabei zeigt sich das wissenschaftliche Selbstverständnis dieser Jahre in der Frage v.a. seiner Adressierung von einer interessanten Paradoxie geprägt. So soll der jeweilige Sprachgebrauch überhaupt erst den szientistischen (...) Anspruch wissenschaftlicher Projekte beglaubigen und diese gleichsam als Spezialdiskurse legitimieren, zugleich muss der ideale Adressat der Wissenschaft solche Spezialdiskurse aber immer auch überschreiten. J. G. Fichte etwa weist den Vorwurf der »Unverständlichkeit« seiner »Wissenschaftslehre« als implizites Verlangen nach »Seichtigkeit« seitens der Leser zurück, zugleich aber erlegt er dem Wissenschaftler die Aufgabe auf, einen Beitrag zum »Fortgang des Menschengeschlechts« zu leisten. Derartigen Spannungen spürt der Band im Kontext vornehmlich des Niedergangs der Rhetorik und der Neubegründung der Universität nach. (shrink)

While the turn to vulnerability in law responds to a recurrent critique by feminist scholars on the disembodiment of legal personhood, this article suggests that the mobilization of vulnerability in the criminal courts does not necessarily offer female drug mules a direct path to justice. Through an analysis of sentencing appeals of female drug mules in England and Wales, this article presents a feminist critique of the dispositif of the person and its relation to vulnerability. Discourses on drug mules’ vulnerability (...) mobilize the trope of the colonial victim in need of protection, which is often translated into legal mercy. But mercy is rather an expression of biopower which inscribes not only fragility onto the bodies of drug mules by figuring them as exemplar paradigms of colonial subjectivity, but also reinvigorates the dispositif of gender implicit in the legal person. In this set-up, it would appear as if law and politics totalize the registers of life, in this case the contours of vulnerable body. The article suggests we must revisit the image of the wounded body in order to carve out a space for resistance. Drawing on Elaine Scarry and Judith Butler, it suggests vulnerable bodies are marked by a semiotic openness, which renders them subject to appropriation but also able to signify the precarity produced by the law through their resistance to representation. Arnold Clapmarius’ ‘Traineeship in politics’. Practical Experience and the Semblance of Practical Experience as a Qualification in the Field of Political Science around the Year 1600. In 1600, Arnold Clapmarius was appointed the first professor for Public Law and Political Science in the Holy Roman Empire by the University of Altdorf. He received this professorship though he had not yet published anything because he was a protégé of Landgrave Maurice the Learned of Hesse-Kassel. Two newly discovered letters which were written (...) by Clapmarius to Maurice show that the young scholar did a traineeship at the Landgrave's court to gather practical experience in politics. This was probably the reason for his appointment in Altdorf. Nevertheless, he hushed up this traineeship because it did not comply to the kind of experience that were expected from a ‘politicus’ at that time, id est military service, educational journeys, foreign languages and regional studies. Thus, this paper fills a gap of Arnold Clapmarius’ biography, and provides a new perspective on the value of practical experience in the field of political science in the Early Modern Period. Nous montrons d’abord que le refus de traduire hypokeimenon par subiectum rend possible une onto-héno-chrono-phénoménologie de la choséité de la chose comme constance. Ensuite, nous démontrons que la tentative visant à penser la transformation de l’ alētheia ne peut éviter la traduction et toutes ses violences. Enfin, nous faisons retour aux Grecs en vue de penser la traduction comme metalēpsis , de réinterpréter la traduction platonicienne des Idées comme choses, de (...) repenser le noūs aristotélicien comme auto-traducteur, et de suggérer que l’origine de la pensée réside peut-être aussi dans la traduction. Ziel des Versuchs ist, Analogien und Differenzen zwischen zwei der Herkunft nach verschiedenen Mystologien aufzudecken. Eckhart vertritt die christlich-westliche, zenbuddhistische Texte vertreten die östliche Variante. Der Vergleich betrifft neben formalen Aspekten der literarischen Gattung die folgenden Punkte: den “Sitz im Leben”, aus dem die Texte entstanden (I), die Autorität des sprechenden Ich (II), das apophatische und das kataphatische Sprechverfahren in ihren Ähnlichkeiten (III/IV) und schließlich die darin hervortretenden Unterschiede (V/VI).

ZusammenfassungDer Beitrag geht von der These aus, dass Goethes Arbeit an der ›klassischen‹ Dramenform sich einer tieferen Einsicht in die zeitliche wie rechtliche Problematik der ›tragédie classique‹ verdankt als allgemein angenommen. Dabei dürfte es maßgeblich die Französische Revolution gewesen sein, die eine neue Attraktivität der ›alten‹ Form bewirkte. Das zeigt sich vor allem an Die Natürliche Tochter, einem Stück, in dessen Entstehungszeit nicht zufällig Goethes Übersetzungen zweier Dramen Voltaires fallen. Figurationen politischer Gründung und Legitimation bildeten das Zentrum des ›klassischen‹ Dramas (...) bereits bei Corneille und stellten es zuverlässig auf eine um 1800 für konservative Autoren aktuelle Zerreißprobe. Die forciert gelassene Präsentation legitimer Herrschaft unter der Berufung auf Zeitkontinuität und lang währende ›Gewohnheiten‹ stand in der ›tragédie classique‹ nämlich in massiver Spannung zur normativen Forderung der ›Einheit‹ der Zeit, die das Drama auf eine disziplinierte Zeitökonomie und idealerweise sogar auf die Synchronisierung von dargestellter Zeit und Zeit der Darstellung verpflichtete. Dort, wo Corneille solche Spannungen entweder zu kaschieren oder politisch zu nutzen versuchte, reißt Goethe in Die Natürliche Tochter zwischen Figurenrede und Dramaturgie eine unüberwindbare Kluft und lässt ursprüngliche Funktionen der ›klassischen‹ Zeitökonomie konsequent leerlaufen. Sein Drama betreibt demnach keine restaurative Formpolitik, sondern führt die historische Uneinholbarkeit der ›klassischen‹ Form angesichts zeitgenössischer politischer Entwicklungen vor.The contribution is prompted by the observation that Goethe had deep insight into the temporal and legal problems of the ›tragédie classique,‹ which was fundamental to his work on the ›classical‹ drama. It was most likely the upheaval in the wake of the French Revolution that rendered the ›old‹ form more attractive. This is especially true for Die Natürliche Tochter. The play was, not coincidentally, written at the same time as Goethe’s translations of two of Voltaire’s dramas. Meanwhile, figurations of political foundation and legitimation had already advanced to the centre of ›classical‹ drama in Corneille’s work. The enforced serene presentation of legitimate rule of the ›tragédie classique,‹ with its reference to the continuity of time and age-old ›habits,‹ was in massive tension with the normative demand for the ›unity‹ of time, which committed the drama to a disciplined economy of time – ideally even to a synchronization of time represented and the time of representation. Where Corneille attempted to either conceal or politically exploit such tensions, Goethe in Die Natürliche Tochter forces an insurmountable chasm between dramaturgy and the speech of the characters and consistently allows the original functions of the ›classical‹ economy of time to run dry. Thus, his drama does not pursue a restorative politics of form, but rather demonstrates the historical unassailability of the ›classical‹ form in the face of contemporary political developments.
